Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of ebykes.nl, including all pages, content, tools and functionality made available on the site (together, the “Website”). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

These Terms apply to everyone who browses the Website, whether or not you create an account or make a purchase. If you go on to buy a product from us, that purchase is separately governed by our Sales Terms & Conditions, which you’ll be asked to accept at checkout — these Terms of Use continue to apply alongside them for your general use of the site.

Who We Are

Definitions

• “Content” means all text, images, product descriptions, specifications, graphics, videos, logos and other material appearing on the Website.
• “User”, “you”, “your” means any person who accesses or uses the Website.
• “User Content” means reviews, ratings, questions, comments or other material you submit to the Website.
• “Services” means the browsing, account, search, comparison and support functionality made available through the Website, excluding the purchase process itself.

Eligibility

The Website is intended for use by individuals who are at least 16 years old, or the applicable age of consent for information society services in your country of residence, whichever is higher. If you are under this age, you may only use the Website with the involvement of a parent or legal guardian.

Your Account

Certain features, such as saving favourites, tracking orders or leaving reviews, may require you to register an account. When you do, you agree to:

• Provide accurate, current and complete information;
• Keep your login credentials confidential and not share your account with others;
• Notify us promptly at support@ebykes.nl if you suspect unauthorised use of your account;
• Accept responsibility for activity that occurs under your account, except where caused by our own security failure.

We may suspend or close an account that we reasonably believe is being used fraudulently, abusively, or in breach of these Terms — see Section 17.

Acceptable Use

You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Website by anyone else. This includes complying with all applicable Dutch and EU law while using the Website.

Prohibited Conduct

Without limiting Section 6, you must not:

• Scrape, crawl, mine or systematically extract Content from the Website using automated means, except for the purpose of standard, well-behaved search-engine indexing;
• Reverse-engineer, decompile or attempt to derive the source code of any part of the Website;
• Interfere with, overload or disrupt the Website’s servers or networks, including via denial-of-service attacks;
• Attempt to gain unauthorised access to any account, system or network connected to the Website;
• Introduce viruses, malware, or other harmful code to the Website;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Submit false, misleading or deceptive User Content, including fake reviews;
• Use the Website to send unsolicited advertising or spam to other users;
• Use automated bots to make purchases, monitor stock, or manipulate pricing tools, without our prior written consent.

We reserve the right to investigate suspected violations and to involve law enforcement where appropriate.

Intellectual Property Rights

Unless otherwise indicated, all Content on the Website — including text, product photography, graphics, layout, software and the ebykes.nl name and logo — is owned by or licensed to us and is protected by Dutch and international copyright, trademark and database rights law.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Website and its Content for your own personal, non-commercial use. You may not reproduce, republish, distribute, publicly display, modify, or create derivative works from any Content without our prior written permission, except where you’re simply sharing a standard link to a page.

Manufacturer names, logos and product images used to describe third-party e-bikes, components and accessories remain the property of their respective owners and are used for identification and descriptive purposes only.

Your Content & Reviews

Where the Website allows you to submit reviews, questions, photos or comments, you retain ownership of what you submit, but you grant us a worldwide, royalty-free, non-exclusive, transferable licence to use, reproduce, adapt, publish, translate and display that User Content on the Website and in our marketing, for as long as it remains published.

You confirm that any User Content you submit is genuinely your own opinion or experience, does not infringe anyone else’s rights, and is not unlawful, defamatory, obscene or misleading. We may moderate, edit for length or clarity, decline to publish, or remove User Content at our reasonable discretion, including where we believe it breaches these Terms.

Third-Party Links & Content

The Website may contain links to third-party websites, such as manufacturer sites, payment providers, delivery partners or social media. These links are provided for convenience only. We do not control and are not responsible for the content, accuracy, or practices of any third-party site, and including a link does not imply our endorsement of it. You access third-party sites at your own risk and subject to their own terms.

Content & Price Accuracy

We take reasonable care to keep product descriptions, specifications, availability and pricing accurate and up to date. However, e-bike specifications, battery ranges, weights and pricing can change between manufacturer updates, and occasional errors can occur despite our best efforts.

Where the Website is used for browsing and comparison, Content is provided for general informational purposes and does not itself constitute a binding offer to sell. Any binding offer, and the specific terms governing price, availability and correction of errors at the point of sale, are set out in our separate Sales Terms & Conditions, which apply once you place an order.

Privacy & Cookies

Our use of your personal data is governed by our separate Privacy Policy, which explains what we collect, why, and your rights under the EU General Data Protection Regulation (GDPR) and its Dutch implementation, the Uitvoeringswet AVG. Our use of cookies and similar technologies is explained in our separate Cookie Policy. By using the Website, you acknowledge that these policies apply alongside these Terms.

Availability & Changes to the Site

We aim to keep the Website available at all times, but we do not guarantee uninterrupted access. We may suspend, withdraw, or restrict availability of all or part of the Website for business or operational reasons, including maintenance, without notice, and we are not liable for any unavailability, however caused.

We may also add, remove or change features, layout or Content on the Website at any time, at our discretion.

Disclaimer of Warranties

The Website and its Content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by Dutch law. We do not warrant that the Website will be uninterrupted, secure, or error-free, or that Content is complete, accurate or current at all times.

Nothing in this section limits any statutory rights you have as a consumer under mandatory Dutch or EU consumer protection law, including in relation to products you purchase from us, which are addressed separately in our Sales Terms & Conditions.

Limitation of Liability

To the fullest extent permitted by law, ebykes.nl shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of, or inability to use, the Website.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under Dutch or EU law.

Indemnification

You agree to indemnify and hold ebykes.nl, its officers, employees and agents harmless from any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Website, except where such claim arises from our own negligence or breach of applicable law.

Suspension & Termination

We may suspend or terminate your access to the Website or your account, without notice, if we reasonably believe you have breached these Terms, engaged in unlawful conduct, or posed a risk to the security or integrity of the Website. You may stop using the Website, or request closure of your account, at any time by contacting support@ebykes.nl.

Sections of these Terms that by their nature should survive termination — including Sections 8 (Intellectual Property), 15 (Limitation of Liability), 16 (Indemnification) and 18 (Governing Law) — will continue to apply.

Governing Law & Disputes

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law provisions. If you are a consumer, this choice of law does not deprive you of the protection of any mandatory provisions of the law of your own country of residence, where applicable under EU consumer protection rules.

Any dispute arising from these Terms that cannot be resolved informally will be submitted to the competent court in the Netherlands, without prejudice to any right you have as a consumer to bring proceedings in the courts of your own country of residence under applicable EU rules. We encourage you to contact us at support@ebykes.nl first, so we can try to resolve any issue directly.

Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in our Website, our Services, or applicable law. The “Last reviewed” date at the top of this page shows when it was last updated. Material changes will be highlighted on the Website. Your continued use of the Website after changes take effect constitutes acceptance of the revised Terms.

General Provisions

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and (where applicable) our Sales Terms & Conditions, constitute the entire agreement between you and ebykes.nl regarding use of the Website, superseding any prior agreements on this subject.

Assignment

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets. You may not assign or transfer your rights under these Terms without our prior written consent.
